1. Who we are
These Terms & Conditions ("Terms") govern your use of the SwiftVendNG platform ("Service"), operated by SwiftVendNG ("SwiftVendNG", "we", "us", "our"). By creating an account or using the Service you agree to these Terms.
2. Eligibility & account
You must be of legal age in your jurisdiction and have authority to enter into these Terms. You must provide accurate information, keep it up to date, and safeguard your account credentials. You are responsible for all activity under your account.
3. The service
SwiftVendNG provides a digital wallet and Value-Top-Up (VTU) platform enabling users to purchase airtime, data, cable TV subscriptions, electricity tokens and examination PINs from third-party providers. Availability of any specific service depends on upstream providers and may change without notice.
4. Acceptable use
You agree not to misuse the Service. Prohibited activities include, without limitation: unlawful use, fraud, spam, infringement of intellectual property, interference with security (malware, probing, scraping), reselling access without authorisation, or reverse engineering the Service.
5. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are described in the Paddle Buyer Terms.
Subscription tiers renew automatically each billing cycle until cancelled. You may cancel at any time through paddle.net or by contacting support.
6. Wallet balances
Funds credited to your SwiftVendNG wallet are intended for use on the Service. Failed provider transactions are automatically refunded to your wallet. Wallet balances are not interest-bearing.
7. Intellectual property
SwiftVendNG retains all rights, title and interest in the Service, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
8. Service availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury where such limitation is prohibited.
10. Suspension and termination
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination your right to use the Service ends immediately; any remaining wallet balance may be refunded subject to verification.
11. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be resolved in the courts of Nigeria.
