1. Who we are

These Terms & Conditions ("Terms") govern your use of the SwiftVendNG platform at swiftvend.live ("Service"), operated by SwiftVendNG ("SwiftVendNG", "we", "us", "our"). By creating an account or using the Service you agree to these Terms.

2. Eligibility & account

You must be of legal age in your jurisdiction and have authority to enter into these Terms. You must provide accurate information, keep it up to date, and safeguard your account credentials and password. You are responsible for all activity under your account.

3. The service

SwiftVendNG provides a digital wallet and Value-Top-Up (VTU) platform enabling you to purchase airtime, data, cable TV subscriptions, electricity credit, betting wallet funding, recharge card PINs and examination PINs from third-party providers. Availability of any specific service depends on upstream providers and may change without notice.

4. Acceptable use

You agree not to misuse the Service. Prohibited activities include, without limitation: unlawful use, fraud, spam, infringement of intellectual property, interference with security (malware, probing, scraping), reselling access without authorisation, or reverse engineering the Service.

5. Payments and membership

Card and bank payments that fund your wallet are processed by Flutterwave, our payment provider. Flutterwave handles the payment itself, including chargebacks, and their payment terms apply to that step. Prices are shown in Nigerian Naira before you confirm, and every charge is calculated on our servers, so the amount you see is the amount you pay.

Membership levels are one-time payments: you pay once and keep that level. There are no automatic renewals, no recurring charges and nothing to cancel. Upgrading charges the upgrade fee from your wallet balance and never moves you to a lower level.

6. Wallet balances

Funds credited to your SwiftVendNG wallet are intended for use on the Service. If a purchase fails at the provider, the amount is automatically returned to your wallet. Wallet balances do not earn interest and are not a bank account.

7. Refunds

Refunds are handled by SwiftVendNG, not by a third-party reseller. See our Refund Policy for how to report a problem and what we return to you.

8. Intellectual property

SwiftVendNG retains all rights, title and interest in the Service, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

9. Service availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury where such limitation is prohibited.

11. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination your right to use the Service ends immediately; any remaining wallet balance may be refunded subject to verification.

12. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be resolved in the courts of Nigeria.
